Upside Payments Inc. ("Upside," "we," "us") is a Utah company that helps businesses get set up to accept card payments. We work with payment processors and banks, and with independent sales agents who refer businesses to us.
This policy explains what information we collect, how we use and share it, and the choices you have. It covers our website (upsidepayments.com) and the information we handle when we help a business apply for payment processing or work with a sales agent.
When your business is approved, the payment processor and bank that provide your account also collect and use your information under their own privacy policies. We'll tell you who they are during the application.
Information we collect
What we collect depends on how you interact with us.

We do not collect or store card numbers from your customers' transactions. Card data is handled by the payment processor.
How we use information
We use information to:
- Respond to inquiries and contact businesses about payment processing services.
- Prepare and submit merchant applications to payment processors and banks, and follow up on underwriting.
- Verify identity and meet the processors' and banks' underwriting requirements.
- Pay sales agents their commissions and file required tax forms.
- Run, secure, and improve our website and internal systems.
- Comply with law, card network rules, and our agreements with processors and banks.
We do not sell personal information, and we do not use it for targeted advertising.
How we share information
We share information only as described here:
- Payment processors and banks. We send merchant application information to the processors and banks you apply with, so they can review and open your account. They use it under their own privacy policies.
- Sales agents. An agent who referred your business may receive updates on your application's status and the information needed to support your account.
- Service providers. Companies that host and run our systems, including cloud hosting, website hosting, email delivery, sign-in, and electronic signature services. They may use the information only to provide services to us.
- Legal and safety. When required by law, subpoena, or court order, or to protect against fraud or to protect our rights or others' safety.
- Business transfers. If Upside is involved in a merger, acquisition, or sale of assets, information may transfer as part of that transaction, subject to this policy.
We do not sell personal information.
Analytics and cookies
Our website uses a privacy-focused analytics service that measures visits in aggregate without cookies or tracking you across other sites. Our internal systems use only the cookies needed to keep staff signed in.
We do not use advertising cookies or allow third parties to track you on our site for advertising.
How we protect information
We use administrative, technical, and physical safeguards to protect the information we hold. These include encryption in transit and at rest, additional encryption for Social Security numbers, tax IDs, and bank account numbers, access limited to staff who need it, multi-factor sign-in, and logging of access to sensitive information.
No system is completely secure. If a breach affects your personal information, we will notify you as required by law.
How long we keep information
We keep information only as long as we need it:
- Merchants and sales agents we work with: for as long as the relationship lasts, and for 4 years after our last payment to you or service for you, to meet tax and recordkeeping requirements.
- Applications and documents that don't lead to a relationship: for 1 year after the last activity on them, then deleted.
After these periods we delete or destroy the information, unless a law or our agreement with a processor or bank requires us to keep it longer.
Your choices
- Marketing email. Every marketing email we send includes a way to unsubscribe. You can also email us to stop being contacted.
- Access and correction. You can ask to see or correct the personal information we hold about you.
- Deletion. You can ask us to delete your information. We may need to keep some of it to meet legal, tax, or contractual requirements, and we'll tell you if so.
To make a request, contact us using the details below. We may need to verify your identity first.
Children
Our services are for businesses and are not directed to children under 13. We do not knowingly collect information from children.
Changes to this policy
We may update this policy. We'll post the new version here with a new effective date, and notify you directly of material changes when we have your contact information.
